Please read these Terms of Service carefully. By accepting a quotation, booking a service, making payment, requesting works to commence, or otherwise engaging Local Dad Lawn & Garden, you agree to these Terms of Service.

Nothing in these Terms excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law.

QUOTATIONS

All quotations are based on information available at the time of quoting, including site inspections, measurements, photographs, client instructions and site conditions. Unless otherwise stated, quotations are valid for 7 days from the date issued. Where site conditions materially differ from those observed or disclosed during the quoting process, Local Dad Lawn & Garden reserves the right to revise pricing, scope of works or labour requirements before proceeding. Any variations requested by the client after acceptance of a quote may result in additional charges.

ONSITE CONSULTATION FEES

For selected service areas outside of Cairns, including but not limited to Kuranda, Atherton and Port Douglas, an onsite consultation fee may apply. Consultation fees must be paid prior to the appointment being confirmed. Consultation fees are refundable if cancelled with at least 24 hours' notice. Cancellations within 24 hours of the scheduled appointment may result in forfeiture of the consultation fee.

BOOKINGS AND DEPOSITS

Certain services may require a deposit before a booking date is secured. Deposits are applied toward the total cost of the project. Where a client cancels a booking after accepting a quotation, Local Dad Lawn & Garden may retain all or part of the deposit to recover reasonable costs already incurred, including administration, scheduling, materials ordered, supplier charges and labour commitments. Any refund entitlement will be assessed on a case-by-case basis and in accordance with Australian Consumer Law.

CLIENT CANCELLATIONS

Clients may reschedule or cancel a service by providing at least 24 hours' notice. Where insufficient notice is provided, a reasonable cancellation fee may apply to recover administration, scheduling and travel costs incurred.

WEATHER, SAFETY AND ACCESS

Local Dad Lawn & Garden reserves the right to postpone, reschedule, suspend or discontinue works where weather conditions, site conditions, safety risks, access restrictions, animal activity, hazardous materials, council restrictions or other circumstances make the works unsafe, impractical or unlawful. If works are delayed due to circumstances beyond our reasonable control, a new service date will be arranged where possible.

PROPERTY ACCESS

The client is responsible for ensuring safe and reasonable access to the property at the agreed service time. Pets must be suitably restrained during service delivery. Where access is unavailable upon arrival, a call-out, travel or rescheduling fee may apply. If keys, gate codes or access instructions are provided, the client warrants they are accurate and operational.

SITE PREPARATION

Clients are responsible for removing or identifying hazards including toys, hoses, tools, pet waste, rocks, hidden irrigation components and other obstacles before service commencement. Where excessive site preparation is required, additional labour charges may apply. Local Dad Lawn & Garden is not responsible for damage to hidden, concealed or unidentified objects that could not reasonably be detected before work commenced.

GREEN WASTE, CLIPPINGS AND DISPOSAL

Unless otherwise stated in the quotation, green waste removal is limited to waste generated by Local Dad Lawn & Garden during the service. Removal of pre-existing waste, household rubbish, soil, rocks, tree stumps, construction materials or hazardous materials is excluded unless specifically quoted. Waste volumes exceeding the quoted allowance may incur additional disposal or labour charges.

REGULAR MAINTENANCE SERVICES

Regular maintenance schedules are subject to weather, seasonal growth, staffing availability, public holidays and operational requirements. While every effort is made to maintain consistent service intervals, Local Dad Lawn & Garden cannot guarantee exact service dates or times. Clients will be notified where significant scheduling changes occur.

PAYMENT TERMS

Unless otherwise agreed in writing, payment is due within 24 hours of invoice issue. Accounts remaining unpaid beyond the due date may incur reasonable administration costs, debt recovery fees, collection agency costs, legal expenses and interest on overdue amounts where permitted by law. Local Dad Lawn & Garden reserves the right to suspend future services until outstanding balances are paid.

COMPLAINTS AND SERVICE CONCERNS

If you are dissatisfied with any aspect of our services, please notify us as soon as reasonably possible. Local Dad Lawn & Garden will investigate all genuine complaints and, where appropriate, provide a reasonable opportunity to inspect, rectify or otherwise address the concern. Nothing in this clause limits any rights available under the Australian Consumer Law.

LIMITATION OF LIABILITY

To the extent permitted by law, Local Dad Lawn & Garden will not be liable for delays, losses or damages arising from circumstances beyond our reasonable control, including weather events, supplier delays, council restrictions, acts of third parties, site access issues or unforeseen site conditions. Nothing in these Terms excludes liability that cannot lawfully be excluded under the Australian Consumer Law.

GIFT CARDS

Gift cards are redeemable only for the services specified at the time of purchase. Gift cards are not redeemable for cash and expire three years from the date of issue in accordance with applicable Australian laws. Any unused balance remaining after expiry may be forfeited to the extent permitted by law.

LANDSCAPING CONSULTATIONS

Landscaping consultation fees cover professional advice, time and recommendations provided during the consultation. Consultation fees are generally non-refundable once the consultation has been delivered. Where a landscaping quotation is accepted, Local Dad Lawn & Garden may credit the consultation fee toward the approved project at its discretion or as advertised.

By providing your contact details and opting in, you consent to receive marketing communications from Local Dad Lawn & Garden. You may unsubscribe at any time using the instructions provided within the communication.

REFERRAL PROGRAM

Referral rewards apply only to new clients who complete their first eligible purchase or service. Local Dad Lawn & Garden reserves the right to amend, suspend or withdraw referral promotions at any time.

GARDEN MAINTENANCE RETAINER TRIAL OFFERS

Discounted trial pricing is available only to clients genuinely considering an ongoing maintenance arrangement. Where a trial offer has been provided and the client elects not to proceed with the ongoing service arrangement, Local Dad Lawn & Garden reserves the right to charge the applicable standard service rate.
